Terms of Use for AI-based functionality

1. Enabling AI-based functionality

‍When using the Platform, the User has the option to enable AI-based functionality ("Opt-In") for a Workspace that provides access to AI features in the Workspace on the Platform (admin privileges required). By enabling AI-based functionality, the User, in addition to the other Terms of Service, agrees to the terms outlined in this section. If the User no longer wishes to use AI-based functionality or disagrees with these terms, the User may disable AI-based functionality at any time (admin privileges required).

2. Use of AI-based functionality: Input and Output

When using AI-based functionality, the User may provide content to be processed by AI-based functionality (“Input”) and receive output generated by AI-based functionality based on the Input (“Output”). For the purposes of this Agreement, both Input and Output are classified as “User Data”. The User is solely responsible for the creation, development, content, operation, maintenance, use, and dissemination of all User Data. The User is solely responsible for all Input and warrants that it has all rights, licenses, and permissions required to provide Input to AI-based functionality. The User is also solely responsible for all use of the Output and for evaluating the Output for accuracy and appropriateness for its use case, including utilizing human review as appropriate.

3. Sharing of Customer Data

The User acknowledges that certain elements of AI-based functionality are powered by OpenAI, LLC (“OpenAI”), a third-party AI service provider. The User acknowledges that by using AI-based functionality, Customer Data will automatically be shared with OpenAI to facilitate the provision of AI-based functionality. Data sharing with OpenAI is governed by agreements and a data processing agreement, designed to ensure the privacy and security of Customer Data. Nonetheless, xenthics explicitly advises the User to avoid inputting any personal data, confidential, or other sensitive information when using AI-based functionality, given that the utilization of emerging technologies such as artificial intelligence inherently carries the general risk of unforeseen privacy implications.

4. Compliance and Prohibited Uses

The User ensures that the Input, access to, and use of AI-based functionality and Output will not (a) violate any applicable laws or regulations or technical documentation; (b) violate these Terms of Service, the Agreement, or any content and use policies xenthics may implement from time to time; or (c) infringe upon, violate, or misappropriate any of xenthics's rights or the rights of any third party. Additionally, the User shall not use AI-based functionality in a manner that violates any OpenAI policy, including, but not limited to the Sharing & Publication Policy and Usage Policies.

5. Disclaimer of Warranties

xenthics does not make any warranties regarding the results that may be obtained from the use of AI-based functionality or the accuracy of any information obtained through AI-based functionality. The User acknowledges that due to the nature of AI-based functionality and artificial intelligence generally, Output may not be unique and other users may receive similar content from xenthics's services.

6. Model Improvement

The User acknowledges that artificial intelligence and machine learning models can improve over time to better address specific use cases. xenthics does not permit OpenAI to use User Data to improve or train their AI models and does not use User Data to improve or train AI-based functionality without the User's permission to do so.
